Former Employee Sued $340,000 Over Company Twitter Account

Twitter Profile Court LawsuitWOW! And the battle for Twitter handle ownership has truly begun. The New York Times reported (source below) that a company is suing an ex-employee for $340,000 for a Twitter account with over 17,000 followers.

Depending on what the court decides, this could be a jumping off point of what the value of a Twitter follower is to a company or their brand. More importantly, companies and the people who are hired to develop the voice and brand on Twitter need to seriously re-evaluate who owns what and get it in writing to protect each other.

In The New York Times article, PhoneDog Media declined to comment for this article except for this statement: “The costs and resources invested by PhoneDog Media into growing its followers, fans and general brand awareness through social media are substantial and are cnsidered property of PhoneDog Media L.L.C. We intend to aggressively protect our customer lists and confidential information, intellectual property, trademark and brands.”

“This will establish precedent in the online world, as it relates to ownership of social media accounts,” said Henry J. Cittone, a lawyer in New York who litigates intellectual property disputes. “We’ve actually been waiting to see such a case as many of our clients are concerned about the ownership of social media accounts vis-á-vis their branding.”

Companies are starting to realize the VALUE of a Twitter following. Twitter followers have value just like an email list, a direct mail list, etc. But who truly owns it? The personality who grew the social voice or the company that lent the credibility and name to the Twitter profile?

What is the value of having a following? The damages being sought by the company in their lawsuit is set at $2.50 a month per Twitter follower? Hmmm…
